Like all other contracts, marriage contracts could be vitiated by duress or mistake. A last-minute prenup might be valid and binding. However, in the event of a dispute, it is at higher risk of being set aside if one party complains about feeling rushed and having insufficient time to properly review the agreement and obtain independent legal advice.

The child support obligation does not automatically end when your child turns 18. After 18, the child may still be entitled to support, if enrolled in fulltime post-secondary education, disabled or unable to become self-sufficient for other just reasons.

Child support is the right of the child and the amount is determined by the gross annual income of the payor/ non-residential parent. As such, the law does not permit parents to lower or eliminate child support, unless under exceptional circumstances.

This does not constitute child support and may be considered as gifts. This misunderstanding could lead to accrual of significant arrears in child support.

While this may seem intrusive, full and frank disclosure is essential to entering a valid and binding marriage contract. The concealment of material assets may form grounds upon which a court may set aside such contracts.
